ANALISIS EFEKTIVITAS PELAKSANAAN PERATURAN DAERAH NO. 4 TAHUN 2014 TENTANG PENGAWASAN DAN PENGENDALIAN PENGADAAN, PEREDARAN DAN PENJUAL MINUMAN ALKOHOL DI KOTA MAKASSAR

Abstract

Penelitian ini bertujuan untuk mengetahui efektivitas pelaskanaan Perda Nomor 4 Tahun 2014 di Kota Makassar dan faktor yang menghambat pelaksanaan pengawasan, peredaran, dan penjualan minuman beralkohol di Kota Makassar. Metode penelitianayang di gunakan adalah penelitian hukum yuridis empiris. Hasil penelitian menunjukkan bahwa Efektifitas Peraturan Daerah Nomor 4 Tahun 2014 tentang Pengawasan Dan Pengendalian Pengadaan, Peredaran dan Penjual Minuman Alkohol Di Kota Makassar dalam bentuk implementasi yaitu pembinnaan dan Pengawasan secara intern dan ekstem, Pembinaan terhadap tempat-tempat penjualan minuman beralkohol secara ilegal, dan penertiban terhadap tempat-tempat penjualan minuman beralkohol secara ilegal. Efektifitas dalam upaya pengawasan yang harus dilakukan oleh Pemerintah Kota Makassar terhadap pihak-pihak terkait di dalam peraturan daerah tersebut terlihat jelas bahwa penjualan minuman beralkohol hanya saja diperbolehkan di tempat-tempat tertentu saja dan harus ada izin usahanya yaitu surat izin usaha perdagangan minuman beralkohol (SIUP MB). Dan faktor yang Menghambat Pelaksanaan Pengawasan, Peredaran, dan Penjualan Minuman Beralkohol di Kota Makassar yaitu kurangnya waktuu penertiban yang dalam diagendakan oleh aparat penegak hukum, kurangnya kekuatan aparat penegak hukum untuk dalam menjangkau seluruh wilayah di Kota Makassar maupun, kurangnya aparat Pemerintah Kota Makassar maupun Pemerintah untuk sosialisasi ke masyarakat dalam Perda tersebut, dan penerapan sanksi bagi pengkomsumsi minuman beralkohol yang terlalu ringan.

This study aims to find out two things, first to find out the efforts of members of the Makassar Biringkanaya Police Police in eradicating the crime of jambret, and secondly to find out the obstacles experienced by members of the Makassar Biringkanaya Police Police in eradicating the crime of jambret. This research was conducted in Makassar City, with the research location in the jurisdiction of the Biringkanaya Police, Makassar City. The type of research used is library research and field research, with the type of research used is empirical legal research, which is a legal research method that functions to see the law in a real sense and examines how the law works in the community. . The data used are primary data obtained directly from the object of research in the field and secondary data obtained from the results of literature studies. Based on the results of research and data analysis that has been carried out, it can be concluded that efforts to eradicate the crime of Curas can be seen from the efforts made by the Police, both pre-emptively, preventively, and repressively. In a pre-emptive effort, the police do this by instilling good values/norms to the community through legal counseling to foster legal awareness in the community so that they comply more with applicable laws and regulations. As a preventive measure, the police carry out regular and ongoing patrols and surveillance. Meanwhile, in a repressive effort, the police carried out investigations, arrested suspects and confiscated evidence. The obstacles experienced by members of the Makassar Biringkanaya Police in eradicating the crime of Curas are the lack of human resources, lack of coordination, increasing crime rates from year to year, lack of facilities and infrastructure, lack of public response to socialization, and lack of community participation.
