PERLINDUNGAN HUKUM HAK MASYARAKAT ADAT MATTEKO TERHADAP HUTAN ADAT DI KECAMATAN TOMBOLO PAO KABUPATEN GOWA

Abstract

Penelitian ini bertujuan untuk mengetahui  pengakuan eksistensi masyarakat hukum adat Tombolo Pao Kabupaten Gowa dan  pelaksanaan prosedur permohonan hak penguasaan hutan adat di Kecamatan Tombolo Pao Kabupaten Gowa. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa pengakuan eksistensi masyarakat hukum adat Matteko secara organisasi Aliansi Masyarakat Adat Nusantra (AMAN) sudah diakui. Pemerintah Desa Erelembang saat ini sangat mendukung proses pengakuan eksistensi masyarakat adat Matteko dengan melakukan seminar dan lokakarya terkait pengakuan masyarakat hukum adat Matteko. Akan tetapi, hingga saat ini belum ada Peraturan Daerah (PERDA) yang dikeluarkan oleh Pemerintah Kabupaten Gowa. Pelaksanaan prosedur permohonan hak penguasaan hutan adat masyarakat hukum adat Matteko harus memenuhi syarat dan prosedur yang dikeluarkan oleh Dinas Kehutanan. Sebagian syarat telah terpenuhi dengan dibantu oleh Aliansi Masyarakat Adat Nusantra (AMAN). Akan tetapi, yang menjadi kendala adalah belum adanya PERDA tentang pengakuan masyarakat hukum adat Matteko sehingga Dinas Kehutanan Kabupaten Gowa hingga saat ini belum belum bisa melakukan proses pengusaan hutan adat. Sebagian sudah dilaksanakan sebagaimana syarat dan prosedur yang dikeluarkan oleh Dinas Kehutanan dengan dibantu oleh Aliansi Masyarakat Adat Nusantra (AMAN).

This study aims to determine: 1) the recognition of the existence of the Undang-undang adat community, the Gowa Regency, 2) the implementation of the procedure for applying for customary forest tenure rights in the Buttono Pao District, Gowa Regency. The research method used is Normative Law research. The study results show that the recognition of the existence of the Matteko Indigenous People as an organization of the Nusantra Indigenous Peoples Alliance (AMAN) has been recognized. Currently, no Regional Regulation (PERDA) is issued by the Government of Gowa Regency. Implementation of the Procedure for Requesting Customary Forest Tenure Rights of the Matteko Customary Law Community must comply with the requirements and procedures issued by the Forestry Service, some of the requirements have been fulfilled with the assistance of the Alliance of Indigenous Peoples of the Archipelago (AMAN), but the obstacle is that there is no PERDA regarding the recognition of the Legal Community Matteko's custom so that the Gowa District Forestry Service has not been able to carry out the normal forest control process until now. Some of them have been carried out according to the terms and procedures issued by the Forestry Service with the assistance of the Alliance of Indigenous Peoples of the Archipelago (AMAN).
