DAYA DUKUNG APARAT PEMERINTAH KOTA MAKASSAR TERHADAP IMPLEMENTASI UNDANG UNDANG NO. 33 TAHUN 2014 TENTANG JAMINAN PRODUK HALAL

Abstract

Penelitian ini bertujuan untuk mengkaji implementasi Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal di Kota Makassar. Tujuan khusus penelitian ini adalah menghasilkan data yang bermanfaat sebagai bahan rekomendasi dalam pembentukan peraturan-peraturan turunan untuk pelaksanaan Jaminan Produk Halal. Metode yang digunakan dalam penelitian ini adalah normatif-empiris. Penelitian normatif-empiris adalah, penelitian hukum mengenai pemberlakuan atau implementasi ketentuan-ketentuan hukum normatif secara in action pada peristiwa hukum tertentu yang terjadi atau dilaksanakan oleh masyarakat. Hasil penelitian menunjukkan bahwa implementasi Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Halal di Kota Makassar belum maksimal. Selain karena aparat pemerintah Kota Makassar belum mengetahui dan mahami secara komprehensif undang-undang itu, sehingga upaya sosialisasi sangat terbatas. Pemahaman para pelaku usaha berkaitan dengan kewajiban sertifikasi halal terhadap setiap produk juga sangat minim, sehingga ketaatan atas undang-undang itu masih sangat rendah.

This study aims to examine the implementation of Law Number 33 of 2014 concerning Guarantees for Halal Products in Makassar City. The specific objective of this research is to produce data that is useful as material for recommendations in the formulation of derivative regulations for the implementation of Halal Product Assurance. The method used in this research is normative-empirical. Normative-empirical research is legal research regarding the enactment or implementation of normative legal provisions in action on certain legal events that occur or are carried out by the community. The results of the study show that the implementation of Law Number 33 of 2014 concerning Halal Assurance in Makassar City has not been maximized. In addition to the fact that Makassar City government officials do not yet know and understand the law comprehensively, so socialization efforts are very limited. Understanding of business actors related to the obligation of halal certification for each product is also very minimal, so that compliance with the law is still very low.
